The Penalties for Drug Trafficking Under Federal Law
If you have been arrested for a federal drug crime, your future is at risk. Even a first-time offense could cost you more than $1 million in fines; however, the penalties you face will ultimately depend on the type and amount of drugs that were uncovered. Certain drugs carry harsher penalties than others, depending on where they fall on the "drug schedule."
You could be sentenced to 5-40 years in prison and fined $5 million (as an individual) if you are caught trafficking any of the following drugs in the United States:
- Cocaine: 500 to 4,999 grams
- Fentanyl: 40 to 399 grams
- Heroin: 100-999 grams
- LSD: 1-9 grams
- Meth: 50-499 grams
- PCP: 100-999 grams
If you are caught trafficking larger quantities of drugs, you could be sentenced to life in prison and fined $8 million. For any other Schedule I or Schedule II drug that was not listed above, the penalties include up to 20 years in prison and $1 million in fines. Trafficking any amount of a Schedule III drug will result in 10 years imprisonment and up to $500,000 in fines.
