How do discharge upgrades work?
You will need to apply to your branch's Discharge Review Board (DRB) for a discharge upgrade or change in discharge reason. In order to get your discharge adjusted, you will need to prove that it was improper or unfair, which is why having a skilled Honolulu military defense lawyer is crucial. You must also submit all medical and/or military records related to the issues pertaining to your request.
Submitting the following may help persuade the Discharge Review Board:
- Your statement
- Statements from others you served with
- Character references
- Educational records
- Post-service employment history
- Credit reports showing good credit
- Information about your good conduct after service
You can choose on your application whether you would like a DRB hearing or you can ask the DRB to decide on your case based on your application.
You may be able to request a hearing if they deny you based on your application. The hearing usually lasts about an hour, but may run longer. Typically, the DRB consists of five officers and other senior members of the active military. You may choose to testify or remain silent. You can also avoid being questioned by making a statement while not under oath. If you receive a majority vote by the board members you will be awarded a discharge upgrade.
